1. Agreement to Terms

By accessing or using Poker Mates ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the App.

These Terms apply to all visitors, users, and others who access or use the App.

2. Description of Service

Poker Mates is a companion application for organizing friendly poker games with friends. The App provides tools for:

• Creating and managing poker groups
• Organizing poker games and tracking participants
• Recording buy-ins, rebuys, and cash-outs for informational purposes
• Calculating settlement information for record-keeping
• Tracking game statistics and player performance
• Creating seating charts and winner predictions

3. Important Disclaimer - No Gambling or Payments

Poker Mates does not support real-money gambling, wagering, betting, or payments of any kind. No money, chips, or credits can be bought, transferred, or redeemed within the App. Any references to buy-ins, winnings, or settlements are informational only and are tracked for personal record-keeping purposes. All settlements, if any, occur outside the App between users. Poker Mates is intended solely for social game organization, statistics tracking, and game management.

By using this App, you acknowledge and agree that:

• You will not use the App to facilitate illegal gambling activities
• You are solely responsible for compliance with local gambling laws
• The App does not process, facilitate, or endorse any financial transactions
• Settlement information is provided for informational purposes only

4. User Accounts

4.1 Account Creation

To use certain features of the App, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Accept all responsibility for activity under your account
• Notify us immediately of any unauthorized access

4.2 Age Requirement

You must be at least 18 years old to use Poker Mates. By using the App, you represent that you are at least 18 years of age.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion.

5. Acceptable Use

You agree not to use the App to:

• Violate any applicable laws or regulations
• Facilitate illegal gambling or betting activities
• Infringe on the rights of others
• Transmit harmful, offensive, or abusive content
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to the App
• Use the App for commercial purposes without authorization
• Impersonate any person or entity
• Collect or store personal data about other users
• Use automated systems or bots to access the App

6. User Content

6.1 Your Content

You retain ownership of any content you submit to the App. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display that content solely for operating and improving the App.

6.2 Content Responsibilities

You are solely responsible for your content and represent that:

• You own or have the necessary rights to your content
• Your content does not violate these Terms
• Your content does not infringe on any third-party rights

6.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without notice.

7. Subscription and Payment

7.1 Free and Pro Plans

Poker Mates offers both free and paid subscription plans. Free plan users have access to limited features. Pro plan subscribers receive additional features as described on our pricing page.

7.2 Billing

Pro subscriptions are billed monthly at $3.99/month. You authorize us to charge your payment method on a recurring basis until you cancel.

7.3 Cancellation

You may cancel your Pro subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.

7.4 Price Changes

We may change subscription prices with 30 days' notice. Continued use after the price change constitutes acceptance of the new price.

8. Intellectual Property

The App and its original content, features, and functionality are owned by Poker Mates Team and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer or decompile the App
• Remove any copyright or proprietary notices
• Use our trademarks without written permission

9. Third-Party Services

The App may integrate with third-party services (e.g., Venmo, PayPal for displaying payment handles). We are not responsible for these third-party services. Your use of third-party services is subject to their respective terms and policies.

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Guarantee

We do not guarantee that:

• The App will be uninterrupted, secure, or error-free
• Results obtained from the App will be accurate or reliable
• Defects will be corrected
• The App will meet your requirements

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKER MATES TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10.4 Settlement Calculations

While we strive for accuracy, we are not responsible for errors in settlement calculations or any disputes arising from game records. All settlements occur outside the App between users.

11. Indemnification

You agree to indemnify and hold harmless Poker Mates Team from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another
• Any settlements or disputes between users

12. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending email notifications for significant changes

Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Modifications to Service

We reserve the right to modify or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Poker Mates Team operates, without regard to conflict of law provisions.

16.2 Arbitration

Any disputes arising from these Terms or the App shall be resolved through binding arbitration, except where prohibited by law.

16.3 Class Action Waiver

You agree to resolve disputes on an individual basis only, and not as part of any class or representative action.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Poker Mates Team regarding the use of the App.
